Tribal hiring practices and several federal laws (as well as the NEW Super Circular – 2 CFR 200) require that the Tribe conduct background investigations of job applicants. Individuals who have contact with children, police officers, trust resource staff, as well as casino employees are required to have a background check. It is also good internal controls policy to conduct background checks on an individual who has access to valuable property or cash. However, the applicant’s civil rights which are dictated by the Privacy Act and other Federal laws must also be respected. Each program is required to establish and define minimum standards of character. Investigation of the person’s federal, state and Tribal criminal history for crimes involving children, sex crimes, crimes against other persons and crimes which impact the safety and well being of clients must be considered. The Tribe must make a determination of risk and suitability and then adjudicate the issue to protect the rights of the parties. This training is for Tribal personnel management staff and all personnel and supervisors involved in hiring.
